1. Introduction
Photon Solar Power (Pty) Ltd (“Photon”, “we”, “us”, “our”) provides solar installation services and supplies solar-related equipment sourced from authorised manufacturers and suppliers. By using our website, products, or services, you agree to these Terms and Conditions.
2. No Manufacturer Liability
Photon does not manufacture any solar equipment, including but not limited to inverters, lithium batteries, solar panels, controllers, and related accessories. All equipment warranties, guarantees, performance claims, and defect assessments fall strictly under the manufacturer’s warranty or the place of purchase.
Photon cannot be held responsible for product defects, manufacturing faults, recalls, software issues, or downtime caused by manufacturer delays.
3. Warranty Claims & Assessments
3.1 Collection & Assessment
– Photon may collect goods from the customer at a call-out/collection fee.
– Goods will be transported to the manufacturer or supplier for warranty assessment and booking-in.
– All diagnosis, repair, or replacement decisions are made solely by the manufacturer.
3.2 Refunds
– Photon does not issue refunds for hardware.
– Refunds, credits, or replacements are handled at the manufacturer’s discretion only.
3.3 Reinstallation
– If a product is repaired or replaced by the manufacturer, Photon may reinstall it at an additional service fee.
4. Certificates of Compliance (CoC)
Photon issues a valid CoC upon completion of an installation.
The CoC becomes void immediately if:
– Any third-party company or individual works on, modifies, tampers with, or alters the installation after Photon has signed off.
– Any components are rewired, relocated, or interfered with by anyone other than Photon.
Photon is not responsible for insurance claim rejections due to third-party tampering.
5. Responsibility for On-Site Damage
After installation is completed and signed off, Photon is not responsible for any damage to equipment caused by:
– Animals, pests, accidental impact, weather, water, fire, theft, or vandalism
– Customer negligence or unauthorised tampering
– Electrical surges, lightning, or municipal supply faults
All post-installation damage becomes the responsibility of the customer or insurer.
6. Customer Responsibilities
Customers must ensure the ongoing safety and performance of the system by:
6.1 Reporting Faults
– Reporting faults or irregular behaviour as soon as they are noticed.
– Allowing Photon access when inspection is needed.
6.2 Routine Maintenance
Customers must:
– Schedule routine inspections where necessary.
– Clean inverter filters, fans, and ventilation areas regularly.
– Ensure equipment is kept free of dust, insects, moisture, and obstructions.
– Maintain proper airflow around all components.
Failure to maintain equipment may void manufacturer warranties.
7. Limitation of Liability
Photon is not liable for:
– Loss of income or business due to equipment downtime
– Delays caused by manufacturers or rejected warranty claims
– Additional costs incurred during warranty processes
– Misuse, incorrect operation, or non-compliance with manufacturer guidelines
Photon’s liability is limited strictly to workmanship performed by Photon.
8. Call-Out Fees
The following are billable and not covered under warranties:
– Collection of faulty equipment
– On-site inspections
– Reinstallations after repairs
– Emergency visits
– Configuration changes requested after installation
9. Use of the Website
The website provides general product and solar information. Photon does not guarantee that all specifications or prices are always accurate or up to date.
10. Agreement
By purchasing from Photon Solar Power (Pty) Ltd or using our services, you acknowledge and agree to these Terms and Conditions.
